On this day, May 6, 2007 of the Liberated Brotherhood, I the Justicar of the Brotherhood now announce the punishment that this Chamber lays upon Dark Jedi Knight Bane.

Upon the conclusion of fair and just proceedings, a jury of your peers finds you:

On the Charge of Dereliction of Duty: GUILTY

On the Charge of Disreputable Behavior: GUILTY ON ALL TWELVE COUNTS

On the Charge of Cloning: GUILTY ON ALL FIVE COUNTS

Sentencing for the party is as follows:

As approved by a sentencing jury, you will be stripped of all medals and awards, demoted to the rank of initiate, and expelled from the Dark Jedi Brotherhood roll permanently, never to return.

DB vs Bane - Justicar's Opinion

Unbeknownst to the Dark Brotherhood leadership, Dark Jedi Knight Bane perpetrated a fraud upon the Master at Arms to gain control of several Dossiers, including that of Grand Master Sarin, and use that control to wreak havoc. On the night of Saturday, April 21st, DJK Bane used information he had previously acquired by deceiving the Master-At-Arms to login as Grand Master Sarin. Once logged in, he abused the website administrative options that are linked to Grand Master Sarin’s dossier in an attempt to virtually take over the Brotherhood.

Deputy Grand Master Halcyon was online at the time and noticed his changed position. Halcyon quickly informed Former Grand Master Jac Cotelin of his removal from DGM. Jac acted quickly and shut down all administrative access from anywhere but his computer. Once the site was secure, we worked to track what had happened and discovered a pattern of deceitful and premeditated behaviors by Bane which extended over a long period.

Bane was charged with multiple counts of multiple crimes by the Chamber of Justice, plead not guilty, and was brought before a jury of his peers. The prosecution and defense both presented arguments, and when the jury finished it's deliberation, they had come to a unanimous decision that Bane was guilty on all counts. This was the first jury case the Chamber has had in several years, since Yacks was Justicar, and it allowed us to firm up our jury procedure, which was previously a hazy and unwritten area.

After the guilty verdict was handed down, the Chamber of Justice considered several sentencing options, and decided that expulsion would be the most appropriate course of action. The Covenant requires that all expulsions be approved by a new jury, so a sentencing jury was composed to review the material and whether expulsion was appropriate. As with the trial jury, they came to the unanimous decision that expulsion was appropriate in this case.

Bane has committed some of the most extensive and horrendous crimes that a member could commit against this club and he did so in a premeditated manner, as he slowly began to set the plan into action over several weeks, and created his first clone an entire year ago. Our Dark Covenant does not contain these crimes specifically, but in reality Bane is guilty of treason and mutiny – he betrayed the trust and confidence of the club, and attempted to take over the Brotherhood. His case was a textbook example of our judicial process in action. It followed every step, including the rare jury trial, and executed it flawlessly. The jurors volunteered their time to serve the Brotherhood, and I thank them for that. In our trusting online community, deceit and fraud are two of the worst crimes - and the most harshly punished.

This all amounts to a lot of wasted time and effort on Bane’s part.

If he was clever enough to perpetrate this intricate fraud, than he should have been clever enough to succeed in the Dark Jedi Brotherhood. Alas he took the loser’s way out and he wasn’t clever enough not to get caught.

Let this stand as a lesson not to cross the shit line and never to take the losers way out.

Are we allowed to know the other names that this Bane has used?

The names weren’t just clones. I believe he hijacked the accounts of respected veterans of the DB including a Grand Master and a high level Equite. Not mentioning the specific names is probably out of respect for those people whose accounts and identities were compromised.

Jury members are allowed to disclose who they are if they so choose. The files involved in a trial like this won't likely be open-book, considering the fact that this was a security issue, and responsible leaders don't show people how to do things that they don't want done.

The charges were listed above, as well as the fact that he was found guilty. That should be more than enough detail for most. And, as has been said, as there were several members in good standing who had their dossiers hijacked, leaving them anonymous helps protect them some.

They can share who they are, but it's up to them to choose to do so.

While I do agree with you, Muz, that the details given above should be more than enough for most; the information should, however, still be available. For one thing, this allows a defense or prosecution to build their case based on starre decisis, or even debate the validity of precedent without citing precedent (petitio principii).

For another, this kind of transparency can help retain confidence in the administration that would otherwise be lost if everything were shrouded to "protect interests."

After each case is completed, the full file containing all the information and emails from the investigation and trial is added to the DB's ftp account. It is accessible there for all DC members who have high enough access to it. I do this so there is complete transparency for all cases, but it is only available to Council members.

In general I don't think the complete details being available to everyone is something we want. Especially in cases where the member is still a part of the DB, those details could be embarrassing and would probably be used against them. If they have served their sentence then they do not need further public embarrassment by having all the details paraded around to everyone.

Aye I do believe that in cases where the member isnt booted there should be some sort of non-disclosure. Also what I meant as to everything should be open to the "public" is all non-sensitive information. I could care less how he hijacked the data base or who he did it to, in fact the old saying "right to know" is very applicable here. That ways if it happened again no one could say hey he knew how the last guy did it. Anywho, I do trust the entire Judicial process we have here, but I, like everyone here have a little advice. If you choose to go with it, yay for me. If not oh well.

We should have full disclosure in this case, I think. The public has a right to know everything so that we can at least be sure that DB judicial system works rather than just say "There was a trial at some point, you can't have any details about it. He's guilty. Don't ask questions."

Merlance, if it helps at all, I was a member of the sentancing jury, and can at least vouch for that part of the proceedings :)

As for the rest of it, if Kir says that's the way things are, I'm quite content to believe him.

Bubbs was responsible for the sentence and it didn't involve revokation of ice cream privileges?! Actually, since Bane got kicked out of the DB I suppose it rather does... :P

Actually in cases such as this (since the member has been expelled) I think that all the files (Investigation, ect) should be opened. Also as a side note, in RL he could be charged with Computer Fraud, theft of password, and one other charge I believe. Out of those 3, 2 of them are felonies which, in Georgia at least is a 15 year sentence. He should count himself lucky we are not a vengful group and want to lay the REAL smack down upon his head.

Geez people stop with the hijacking the database and the elite hacks Bane used or the passwords he stole...all he did was impersonate a GM, it's enough to do anything except get passwords. :P
